Terms of Use
1. Provider and scope
Product name: MEMOORB. Brand: FLYOKAY. Models: TSM028-BP and TSM028-BG. Both models have the same functions and data processing described in this document.
These terms govern use of FLYOKAY with MEMOORB (TSM028-BP / TSM028-BG). Provider: Dongguan Tesimai Electronic Technology Co., Ltd.. Address: Room 1801, Building 1, No. 4, Headquarters 2nd Road, Songshan Lake Park, Dongguan, Guangdong Province, China. Contact: tesimai01@163.com. They describe app use and do not replace the purchase contract, product safety instructions or mandatory consumer rights.
2. Local service and requirements
FLYOKAY provides local content editing, Bluetooth device control and status display. This operating model requires no cloud account or cloud subscription. A compatible phone, required permissions and a powered-on product within usable Bluetooth range are needed. Features and displayed status can depend on the operating system and device firmware.
Connection stability, transfer time and status-update frequency depend on distance, interference, phone capabilities and workload. No fixed throughput or uninterrupted real-time availability is promised. Separate commitments made at sale and mandatory conformity, security and update duties remain applicable.
3. Duration and ending use
The local app-use agreement has no fixed term. You may end it at any time without a termination fee by stopping use and uninstalling the app. Disconnecting Bluetooth or withdrawing permissions can stop individual functions. There is no cloud account or cloud subscription to cancel.
Device content, exported phone files and backups require separate deletion. Ending app use does not affect accrued rights, lawful after-sales claims or statutory data-access rights. An indefinite agreement is not a promise of perpetual compatibility, updates or technical support; applicable legal duties and any separately agreed support period still apply.
4. Content and permitted use
You retain the rights you hold in your own content. Grant only the permissions needed for local processing and transmission selected by you; these terms do not grant us a right to advertise with or sell your content. Use media you are entitled to use and respect other people’s privacy and intellectual-property rights.
Do not use the product unlawfully or interfere with others’ devices or security. Rights in the app, firmware and supplied materials remain with their respective owners. Any limits on copying or reverse engineering apply only to the extent permitted by law and do not restrict mandatory interoperability or data-access rights.
5. Data access, sharing and trade secrets
The accompanying product data information and privacy policy explain data types, local storage, retention and access. View available current state and stored content through the connected app. Requests for access, interpretation information, sharing with a chosen third party, or ending arranged sharing can be sent to tesimai01@163.com, identifying the product and requested data.
We currently impose no trade-secret-based access restriction on the operating-status data and user-created display content described in the product information. Access does not in itself grant a right to app or firmware source code. Necessary information to interpret and use in-scope data will be handled according to applicable law. Applicable free access and other statutory rights remain unaffected.
No server-side continuous sharing feed is provided. Data held only on the user’s phone/product may require local steps; we do not promise to remotely recover deleted data. A recipient’s already delivered copies cannot be remotely recalled. Users may complain about an alleged Data Act violation to the competent authority designated under Article 37, without prejudice to other remedies.
6. Changes, interruptions and provider termination
Changes may be necessary for security, legal compliance, operating-system compatibility or maintenance. We will give reasonable advance notice of material changes affecting contractual rights where practicable; urgent security or legal measures may require immediate action. Where required, we will obtain agreement to contractual changes. Continued use alone will not replace consent where the law requires it.
We may terminate app-use permission for a material breach after notice and a reasonable opportunity to remedy it, unless serious unlawful conduct, an immediate security risk or a legal obligation justifies immediate action. Mandatory consumer remedies and data rights remain unaffected. No remote deletion of solely local data is promised or authorised by this clause.
7. Responsibility and statutory rights
Use the product according to its safety instructions and keep copies of content you wish to retain. Neither these terms nor a service-quality description excludes liability or remedies that cannot lawfully be excluded, including applicable consumer conformity and product-liability rights. Any responsibility for loss or interruption is assessed under applicable law rather than a blanket exclusion.
8. Applicable law and disputes
The laws of the People’s Republic of China apply to the extent permitted by mandatory law. For consumers, this choice does not deprive them of mandatory protections of the law that would apply without the choice. Nothing in these terms limits any mandatory right to bring a claim in a competent court of the consumer’s place of residence. You may contact us to seek a resolution without giving up court, regulatory or other statutory remedies.
